Challenges And Solutions In The Protection Of Copyright In The Modern Digital Era: An Indian Perspective
Main Article Content
Abstract
The dissemination of copyright information online has significantly altered the pre-existing rules as a result of the development of digital technology. Unfair use and unlawful downloading of content that is protected by copyright, such as software, videos, songs, etc., have become serious issues in the digital space. As technical and legal remedies to these problems, attempts have been made to develop tools like encryption, digitization, and watermarking as well as to draught numerous international treaties and agreements like TRIPS, ACTA, WCT), and the WPPT etc.
The Indian Copyright Act, which was amended in 2012, appears to be sufficient to address the concerns about infringements in the digital domain; hence, the question of whether India should sign the WCT and WPPT is currently being debated by the Indian government. The evolution of the digital sphere has changed the parameters within which the owners of copyrights must consider the use of various methods to safeguard their works. Act No. 14 of 1957 for the protection of copyright, numerous international copyright conventions and agreements, Limitations and exclusions of TRIPS, and other topics are covered in this article and the worth of the numerous agreements that are available in cyberspace. Also taken into consideration are measures to stop the unauthorized use of copyright content. The conclusion of the paper presents some suggestions and ideas that might be useful in implementing regulations against unauthorised copying and unfair use of copyright content.
